All orders placed on the Internet with L'ESPRIT DU VIN, S. LOHRMANN (hereinafter referred to as "L'ESPRIT DU VIN") are governed by these General Terms and Conditions of Sale, which apply to the exclusion of all other conditions.
By placing an order you acknowledge that you have read, understood and accepted, without reservation, these General Terms and Conditions of Sale.
By using this site, you also agree to be bound by our Terms of Use and our Privacy Policy.
L'ESPRIT DU VIN encourages you to read these General Terms and Conditions of Sale carefully before using the services provided on this site.
L'ESPRIT DU VIN reserves the right to modify these Terms and Conditions of Sale at any time by publishing a new version on this website. Any order placed after L'ESPRIT DU VIN publishes the new version of its Terms and Conditions of Sale constitutes acceptance of those new terms.
2. Registration
The law prohibits the sale of spirits, aperitifs and alcopops to persons under the age of 18, as well as the sale of wine, beer and cider to persons under the age of 16.
When you register on this site, you declare that you are at least 18 years old and have full legal capacity, that is to say, the exercise of your civil rights.
You must ensure the accuracy and completeness of the mandatory data you provide.
Please inform L'ESPRIT DU VIN of any change of address and other modifications by updating your personal data on this site as soon as possible.
L'ESPRIT DU VIN is committed to treating your data confidentially in accordance with the Swiss Federal Act on Data Protection (FADP) and the European General Data Protection Regulation (GDPR), and will not share it with third parties without your consent. 3. Password
You must choose a password when you register in order to use this site. This password is strictly confidential and must not be disclosed to any third party under any circumstances.
You assume full responsibility for the use of your password and for all orders placed on this site, even without your knowledge, using that password.
If you are aware of or suspect any fraudulent use of your password, you must inform L'ESPRIT DU VIN immediately.
4. Validity
The prices published at the time of ordering are applicable subject to changes in vintage, price adjustments and modifications to offers depending on the availability of wines.
L'ESPRIT DU VIN reserves the right to modify its product range, vintages, prices, terms and availability, as well as to correct obvious errors and typographical mistakes. Claims for damages due to obvious errors or typographical mistakes are excluded.
5. Orders
By placing an order on this site, you agree to purchase the products you have selected in accordance with these Terms and Conditions of Sale.
There is no minimum order quantity unless otherwise stated.
L'ESPRIT DU VIN offers its products for sale on this website, subject to availability. If a product purchased and listed as "in stock" on the website is out of stock, L'ESPRIT DU VIN will contact you within 72 hours to arrange an exchange or a partial or full refund (as preferred by the customer). See article 11.
6. Order Confirmation
Orders placed on this site are to be considered as an offer to enter into a contract, subject to acceptance by L'ESPRIT DU VIN and therefore do not constitute a binding contract until they have been confirmed by an email from L'ESPRIT DU VIN.
L'ESPRIT DU VIN reserves the right, at its discretion, to refuse an order, particularly in the event of unpaid invoices or insolvency.
The data recorded by L'ESPRIT DU VIN constitutes irrefutable proof of the order or transaction. The data recorded by the payment system constitutes irrefutable proof of financial transactions.
7. Price
All prices shown on the website are in Swiss francs (CHF), including VAT of 7.7% or 2.5%.
All orders must be paid in full and exclusively in Swiss francs.
The prices shown for the merchandise you order are those shown on this site on the date of the order, including VAT, but excluding processing and shipping costs.
Processing and shipping fees are charged at the rates indicated on this site on the date of the order and calculated in particular according to weight, volume and geographical destination.
L'ESPRIT DU VIN reserves the right to modify its prices and processing and shipping fees at any time and to cancel any contract that contains errors in wording, printing or calculation.
8. Payment terms
Orders can be paid for by credit card (Visa, MasterCard), debit card (Vpay, Maestro, PostFinance Card), TWINT, or bank transfer. In all cases, delivery will only be made after payment has been received. Cash payment in CHF upon delivery is accepted only in the canton of Geneva and part of the district of Nyon.
The ordering and payment process is secured by our financial partners (myPOS Europe Ltd., PostFinance SA). L'ESPRIT DU VIN assumes no responsibility for any fraudulent use of the aforementioned payment methods.
9. Quantities
Our wines are usually delivered in their original packaging (6 or 12 bottles). However, you can order individual bottles at no extra charge. You will only be charged for packaging and shipping.
10. Delivery
All orders confirmed by L'ESPRIT DU VIN will be delivered to the address indicated on the order.
L'ESPRIT DU VIN makes every effort to ensure delivery within 2 to 3 business days of receiving the order (depending on the type of product and the destination country, Switzerland and Liechtenstein). This applies only to products in stock. No claims for price reductions or damages can be made in the event of a delivery delay.
Our goods are delivered exclusively in Switzerland and Liechtenstein. You will find information regarding delivery zones and rates in the Delivery section of our online shop.
Delivery charges are calculated automatically at checkout.
Free delivery is offered for all orders over CHF 99.00.
During special periods or special offers, delivery charges may vary. Please refer to the relevant section for applicable rates.
11. Out of stock
In the event of a product being permanently out of stock, L'ESPRIT DU VIN will inform you as soon as possible and offer you the following alternatives:
- replacement with the next vintage or an equivalent product; or
- refunds for unavailable products or for the entire order, depending on the customer's choice.
In the event of a temporary stock shortage, L'ESPRIT DU VIN will offer you the option of waiting until the restocking date, which will be specified as soon as possible. If this option is not accepted, the customer may request a partial or full cancellation of their order.
12. Verification of the goods
It is your responsibility to check the quantity and condition of the goods immediately upon receipt of the delivery.
If you notice that any merchandise is missing or damaged, you must file a claim with the carrier and inform L'ESPRIT DU VIN by email within 7 days of delivery. The missing or damaged merchandise will then be replaced with identical items, subject to availability.
13. Special packaging and gift packaging
Gift wrapping or special packaging is charged.
14. Returns
You can return any merchandise that does not suit you within 14 days of receiving the order.
L'ESPRIT DU VIN only accepts returns of merchandise in good condition and in their original packaging accompanied by a paper copy of the invoice.
When returns are made in the prescribed manner, L'ESPRIT DU VIN will refund the price of the returned merchandise within a maximum of 30 days from the date of receipt. Processing and shipping costs are your responsibility.
15. Corked/defective bottles
Bottles with a "corked" taste are not eligible for a refund unless it is a case of repeated cork taint. In that case, bottles returned at least three-quarters full with the original cork will be replaced free of charge. If replacement is not possible, you will receive a credit in the form of a personal promotional code. These refund conditions are valid for a maximum of six months from the date of purchase.
16. Limitation of Liability
The photos and texts illustrating and describing the products on this website are for informational purposes only and are not contractually binding. L'ESPRIT DU VIN accepts no responsibility for any errors or omissions in the photos or texts appearing in the offers or services presented on the website. No claims for damages may be made in the event of obvious errors or typographical mistakes.
17. Applicable Law/Jurisdiction
These General Terms and Conditions of Sale are governed by Swiss law.
Any dispute is subject exclusively to Swiss law. The place of jurisdiction is Geneva.
