1. Application of the General Terms and Conditions of Sale

All orders placed online with L’ESPRIT DU VIN, S. LOHRMANN (hereinafter referred to as “L’ESPRIT DU VIN”), are governed by these General Terms and Conditions of Sale, which apply to the exclusion of all other conditions.

By placing an order, you acknowledge that you have read, understood, and unreservedly accepted these General Terms and Conditions of Sale.

By using this website, you also agree to be bound by our Terms of Use and our Privacy Policy.

L’ESPRIT DU VIN encourages you to read these General Terms and Conditions of Sale carefully before using the services provided on this site.

L’ESPRIT DU VIN reserves the right to modify the General Terms and Conditions of Sale at any time by posting a new version on this website. Any order placed after the publication of the new version shall be deemed acceptance of the updated conditions.

2. Registration

The law prohibits the sale of spirits, aperitifs, and alcopops to persons under 18 years old, as well as the sale of wine, beer, and cider to persons under 16 years old.

When registering on this website, you declare that you are at least 18 years old and have full legal capacity, meaning the ability to exercise your civil rights.

You must ensure that the mandatory information you provide is accurate and complete.

Please inform L’ESPRIT DU VIN of any change of address or other modifications by updating your personal data on this website as soon as possible.

L’ESPRIT DU VIN undertakes to process your data confidentially in accordance with the Swiss Federal Act on Data Protection (FADP) as well as the European General Data Protection Regulation (GDPR) and not to disclose it to third parties without your consent. Furthermore, only data necessary for the conclusion and performance of the contract is processed by L’ESPRIT DU VIN. 3. Password

You must choose a password when registering to use this site. This password is strictly confidential and must not be disclosed to third parties under any circumstances.

You assume full responsibility for the use of your password and for all orders placed on this website using it, even without your knowledge.

If you become aware of or suspect fraudulent use of your password, you must inform L’ESPRIT DU VIN immediately.

4. Validity

The prices published at the time of the order apply, subject to vintage changes, price adjustments, and modifications of the offers depending on wine availability.

L’ESPRIT DU VIN reserves the right to modify the product range, vintages, prices, conditions, and availability, as well as to correct obvious errors and misprints. Claims for damages due to obvious errors or misprints are excluded.

5. Orders

By placing an order on this website, you agree to purchase the products you have selected in accordance with these General Terms and Conditions of Sale.

There is no minimum order quantity unless otherwise indicated.

L’ESPRIT DU VIN offers its products for sale on this website within the limits of available stocks. In the event of a stock shortage for a product purchased and indicated as “in stock” on the website, L’ESPRIT DU VIN undertakes to contact you within 72 hours to arrange a replacement or a partial or full refund of the order (according to the customer's preference). See article no. 11.

6. Order Confirmation

Orders placed on this website are considered an offer to conclude a contract, subject to acceptance by L’ESPRIT DU VIN, and are therefore not binding until confirmed by an email from L’ESPRIT DU VIN.

L’ESPRIT DU VIN reserves the right to refuse an order at its discretion, particularly in the case of unpaid invoices or insolvency.

Data recorded by L’ESPRIT DU VIN constitutes irrefutable evidence of the order or transaction. Data recorded by the payment system constitutes irrefutable evidence of the financial transactions.

7. Prices

All prices indicated on the website are in Swiss francs (CHF), including VAT at 8.1% or 2.6%.

All orders must be paid in full and exclusively in Swiss francs.

The prices of the merchandise you order are those shown on this website on the date of the order, including VAT, but excluding handling and shipping fees.

Handling and shipping fees are charged at the rates indicated on this website on the date of the order and are calculated based on weight, volume, and geographical destination.

L’ESPRIT DU VIN reserves the right to modify its prices and handling/shipping fees at any time and to cancel a contract containing obvious typographical, printing, or calculation errors.

8. Payment Methods

Orders must be paid by credit card (Visa, MasterCard), debit card (Vpay, Maestro, PostFinance Card), or TWINT. In all cases, delivery will only be made after payment has been received. The order and payment process is secured by our financial partner (Stripe). L’ESPRIT DU VIN assumes no responsibility for fraudulent use of any of the above payment methods.

9. Quantities

Our wines are usually delivered in their original packaging (6 or 12 bottles). However, you may also order individual bottles at no extra cost. Only packaging and shipping fees will be invoiced.

10. Delivery

All orders confirmed by L’ESPRIT DU VIN will be delivered to the address indicated in the order.

L’ESPRIT DU VIN does its utmost to ensure delivery within 3 business days following receipt of the order (depending on the type of product and destination country, Switzerland and Liechtenstein). This applies only to products in stock. No claim for price reduction or damages may be made in the event of delayed delivery.

Our merchandise is delivered exclusively in Switzerland and Liechtenstein. Information on delivery zones and rates can be found in our online shop under Delivery.

Shipping fees are calculated automatically at checkout.

Shipping is free for any order of CHF 150 or more.

During special periods or promotions, shipping fees may vary. Please refer to the relevant section for applicable rates.

11. Stock Shortage

In case of a permanent stock shortage for an ordered product, L’ESPRIT DU VIN will inform you as soon as possible and offer you the following options:

– replacement with the next vintage or an equivalent product; or
– a refund of the unavailable products or the full order, according to the customer’s choice.

In case of a temporary stock shortage, L’ESPRIT DU VIN will suggest waiting until the indicated restocking date. If this option is not accepted, the customer may request partial or full cancellation of the order.

12. Verification of Merchandise

It is your responsibility to check the quantity and condition of the merchandise immediately upon delivery.

If you find missing or damaged merchandise, you must file a claim with the carrier and inform L’ESPRIT DU VIN by email within 7 days of delivery. Missing or damaged merchandise will be replaced identically depending on available stock.

13. Special Packaging and Gift Wrapping

Gift wrapping and special packaging are charged.

14. Returns

You may return merchandise that does not meet your expectations within 14 days of receiving your order.

L’ESPRIT DU VIN accepts only merchandise returned in good condition and in its original packaging, accompanied by a printed copy of the invoice.

When returns are made in the prescribed manner, L’ESPRIT DU VIN will refund the price of the returned merchandise within a maximum of 30 days from the date of receipt. Handling and shipping fees are at your expense.

15. Corked/Defective Bottles

Bottles presenting a “cork taint” are not refunded unless repeated incidents occur with a specific wine. In such cases, bottles returned at least 3/4 full with the original cork will be replaced free of charge. If replacement is impossible, a credit note in the form of a personal promotional code will be issued. These refund conditions are valid for a maximum of 6 months from the date of purchase.

16. Limitation of Liability

Images and texts illustrating and describing the products on this site are non-contractual and provided for information purposes only. L’ESPRIT DU VIN accepts no responsibility for errors or omissions in the photos or texts shown in the offers or services provided on the site. No claim for damages may be made in the event of obvious errors or typographical mistakes.

L’ESPRIT DU VIN cannot be held responsible for fraudulent content in the event of redirection to malicious links from hyperlinks on its own website. By clicking on embedded links, users visit external websites at their own risk.

17. Applicable Law / Jurisdiction

These General Terms and Conditions of Sale are governed by Swiss law.

Any dispute is exclusively subject to Swiss law. The place of jurisdiction is Geneva.
